Version 2 · Effective October 20, 2026 · Middlesex Notary Co LLC d/b/a CIVIL CONSTABLE
This Refund and Cancellation Policy (the “Policy”) governs cancellations and refunds for requests and assignments handled by Middlesex Notary Co LLC d/b/a CIVIL CONSTABLE (“CIVIL CONSTABLE,” “we,” “us”). It forms part of the Civil Process Service Agreement and the Terms and Conditions. Nothing in this Policy limits any right you have under Massachusetts or federal law.
1. Principle
You pay for work actually performed and costs actually incurred, as stated in your written quote (the “Quote”). CIVIL CONSTABLE does not charge cancellation penalties and does not retain payments for work it has not performed.
2. Withdrawal Before Acceptance
You may withdraw a request at any time before CIVIL CONSTABLE confirms acceptance in writing, at no charge, through the client portal, by email to info@civilconstable.com or by telephone at 781-579-7462. Any amount paid before acceptance will be refunded in full. If CIVIL CONSTABLE declines a request, any amount paid will be refunded in full.
3. Cancellation After Acceptance, Before Work Begins
If you cancel an accepted assignment before any service attempt, travel, document preparation or other work has begun, all amounts paid will be refunded in full.
4. Cancellation After Work Has Begun
4.1 If you cancel after work has begun, you are responsible only for:
- service attempts already made, at the per-attempt rate stated in the Quote;
- travel and other work already performed, as itemized in the Quote; and
- out-of-pocket costs already incurred for the assignment (such as postage, certified mail or court copy fees), at cost.
4.2 Where the Quote states a single fee for the assignment, the amount charged for partially performed work is the portion of that fee reasonably attributable to the work performed, which CIVIL CONSTABLE will explain to you in writing.
4.3 Any amount paid in excess of the charges described in this Section will be refunded.
5. Attempted but Unsuccessful Service
5.1 Service attempts are work performed. If CIVIL CONSTABLE completes the attempts described in the Quote but cannot serve the recipient (for example, because the recipient cannot be located, the address is incorrect, or access is refused), the fees for those attempts are not refundable, and you will receive a record of the attempts.
5.2 If service is unsuccessful because of an error by CIVIL CONSTABLE, CIVIL CONSTABLE will, at your option, make an additional attempt at no charge or refund the fee for the affected attempt.
6. Cancellation by CIVIL CONSTABLE
If CIVIL CONSTABLE cancels an accepted assignment because it cannot lawfully or safely be completed, all amounts paid for work not performed will be refunded. If the cancellation results from materially inaccurate or incomplete documents or information that you did not correct after notice, the charges described in Section 4 apply.
7. Deposits
A deposit is a partial payment toward the quoted fee. It is not a non-refundable fee. Deposits are applied to work performed, and any unused amount is refunded under this Policy.
8. Witness Fees and Other Pass-Through Amounts
Witness fees, mileage and other amounts you provide to be delivered with a document belong to the recipient once tendered. Amounts that were not tendered are returned to you in full.
9. How Refunds Are Paid
9.1 Refunds are issued to the original payment method. Card and wallet refunds are processed through Stripe; most financial institutions post them within five to ten business days after processing. Payments received by check or another offline method are refunded by check or another method agreed with you.
9.2 CIVIL CONSTABLE issues refunds promptly after the cancellation or determination giving rise to them.
9.3 Refunds are not reduced by card processing fees.
9.4 Each refund is confirmed to you by email and reflected on the invoice in your client portal.
10. Billing Questions, Disputes and Chargebacks
10.1 If you believe a charge is incorrect, please contact CIVIL CONSTABLE first at info@civilconstable.com or 781-579-7462 with your invoice number. We will review the charge and respond in writing.
10.2 You retain any right you have to dispute a card charge with your card issuer. If a payment is disputed, CIVIL CONSTABLE may provide the card issuer, through Stripe, with the Quote, the signed authorization and records of the work performed.
