Massachusetts Records-Only Subpoena
Commands production of documents, ESI or tangible things in a Massachusetts civil action without personal appearance (Mass. R. Civ. P. 45).
Instructions
- Complete the caption, recipient, records description, production deadline and lawful place or destination of production.
- Use Schedule A when the records description doesn’t fit.
- The subpoena is issued — and signed — by a clerk, notary public or justice of the peace. The issuer section is left blank for that purpose.
- Rule 45 and the template’s own notes address prior service of copies on the parties; your counsel determines what notice is required in your case.
- Protected categories (for example medical, mental-health or education records) can require additional authorizations, notices or court orders.
Signing
Ink or official signature by the issuing clerk, notary public or justice of the peace.
