Massachusetts Deposition Subpoena
Commands a witness to attend and testify at a deposition, with optional production (Mass. R. Civ. P. 30 and 45). Includes a return-of-service section.
Instructions
- The template notes that the notice of deposition is served before the subpoena is issued; it does not replace the notice.
- Complete the deposition date, time, place and method. Confirm the place complies with Rule 45(d)(2).
- Tender of the witness fee and mileage is required when attendance is commanded; the amounts are set by statute.
- The issuer section is completed by the clerk, notary public or justice of the peace. The return of service is completed by the server after service.

Issuer signs by hand; the server signs the return after service.
