Website Terms
The terms that apply when you use civilconstable.com, its request forms, the Document Center and the client portal.
Highlighted statements must be confirmed by Civil Constable (and ideally reviewed by counsel) before launch. Set SHOW_DRAFT_FLAGS=false once confirmed.
Effective date: Confirm before launch: set the effective date at launch
Using this website
By using this website you agree to these terms. If you don’t agree, please don’t use the site. Civil Constable may update these terms; the current version is always on this page.
Requests are not engagements
Submitting a request form asks Civil Constable to review an assignment. It doesn’t create a contract or an engagement, and it doesn’t guarantee that the assignment will be accepted, attempted or completed by any date. An assignment is accepted only when Civil Constable confirms acceptance in writing on agreed terms, after any required authorization or payment.
No legal advice
Civil Constable is not a law firm, court, sheriff’s department or government agency. Information on this site, in the Document Center and in communications from us is general information, not legal advice, and doesn’t create an attorney-client relationship. See the Legal Disclaimer.
Your responsibilities
- Provide accurate, complete information and documents, and only documents you are authorized to have served.
- Determine, with your counsel, which documents to use, their legal sufficiency, and all legal deadlines.
- Supply witness fees, mileage or other funds that must accompany a document.
- Keep your email account secure, because portal sign-in links are sent there.
- Don’t upload malicious files, attempt to access other people’s information, or interfere with the site’s operation.
Document Center
Templates prepared by Civil Constable are provided “as is” for convenience. They are not official court forms and have not been approved by any court. Official forms are identified with their source. You are responsible for choosing and completing forms correctly and for any signatures, notarization or filing they require. Forms you fill in your browser stay on your device unless you send them to us.
Electronic records and signatures
If you agree to sign a service authorization electronically, you consent to receive and sign that document electronically through the portal. You can instead ask for a paper authorization at any time by emailing us. Electronic signing is not offered on this site for court forms, notices to quit, subpoenas or affidavits.
Availability
We work to keep the site available and secure but can’t promise uninterrupted access. If the site is unavailable near a deadline, call 781-579-7462.
Limitation of liability
To the extent permitted by law, Civil Constable is not liable for losses arising from use of this website or its templates, or from information you provide. Liability for accepted assignments is governed by the terms of the accepted scope and quote. Confirm before launch: have counsel review this limitation clause
Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts.
